Young people win court case against government promoting fossil fuels
In the first ruling of its kind in the United States, a Montana state court decided in favor of 16 young people who sued the state alleging it had violated their right to a “clean and healthful environment” by promoting the use of fossil fuels.
The judge found that a state law that prevents consideration of climate change in making permitting decisions violates the state constitution. Her ruling requires Montana, a major coal and gas producing state, to consider climate change when deciding whether to approve or renew fossil fuel projects. While the decision is still subject to appeal, even this finding is expected to have a significant impact—resulting in more cases being brought successfully throughout the United States.
